WEST MILFORD COUNCIL MAY GO PAPERLESS

WEST MILFORD COUNCIL MAY GO PAPERLESS
Byline: DAVID M ZIMMERE-mail: zimmer@northjersey.com
Section: LOCAL
Type: News
WEST MILFORD -- The council will look into whether it can go paperless by receiving documents in digital form via portable computers.
Council members now are given information packets including resolutions, contracts, and accompanying documentation the week before a meeting.
Township Administrator Kevin Boyle said the folders are typically stuffed with several hundred sheets that take the clerk's office a few hours to print and package. He said the cost is more than $250 just for the paper needed to make packets for 24 council meetings, not to mention added budget meetings.
Councilmen Michael Ramaglia, Daniel Jurkovic and Joseph Smolinski will meet with Township Clerk Antoinette Battaglia to discuss the possibility of ending that practice.
Taken from e-mails
For a council constantly discussing environmental concerns, Ramaglia and Jurkovic said, the concept is worth looking into.
Ramaglia said much of the information in the packets is taken from e-mails. That, Jurkovic said, results in a lot of paper wasted.
Neighboring Jefferson has already switched to all-digital document transmission
There, paperless procedures were started nearly a decade ago by Lydia Magnotti, former municipal clerk and regional expert on going digital, and the wife of former West Milford Treasurer Arthur Magnotti.
Current Jefferson Township Clerk Lori Harvin said the switch significantly reduced the time it takes to photocopy documents for the council.
It has allowed for almost immediate updates to documents, which can be accessed on the municipal server by officials through a simple Internet connection.
Should save money
Boyle said West Milford could switch to a paperless system relatively simply. He said the only obstacle is cost, which Harvin said doesn't surprise her.
"There may be some hesitation because of the initial outlay," she said. "Still, in the end, it probably does save money."
Server upgrades to allow for more users on the municipality's secure network would cost around $2,000, and computers for council members are an added cost.
Boyle said a compatible computer would cost around $550. All things considered, he said, the system would eventually pay for itself.
However, Ramaglia wants to accelerate savings by requiring council members to buy their own laptops.
Current council members have agreed to that.

QLD:Qld man's treasure is now anyone's trash
BRISBANE, Aug 30 AAP - A Sunshine Coast man is trying to persuade his council to sift
through local tips to find $50,000 of his wife's jewellery that was accidentally threw
out.
Geoff, who did not want to give his last name, said the jewellery was stored in garbage
bags and were mistakenly placed in wheelie bins during a pre-move clean-up, he told The
Courier-Mail.
The uninsured treasure included charm bracelets, bangles and pure gold bars and was
possibly dumped at Nambour tip.
"We're moving house, and I told the kids to give me any garbage lying around for me
to throw out," he said.
"My wife rang me up when I was at work and said: 'Where are the bags?'
"You know that sick feeling you get? Wow."
Sunshine Coast Regional Council have given Geoff little hope of seeing the heirlooms again.
"To locate the lost items, this decaying compacted waste would need to be systematically
excavated and sorted mechanically by the contractor," a council spokesman told the newspaper.
The majority of the gold was bought as an investment while the couple lived in the
UK more than 25 years ago.
Geoff and his wife, Carol, were due to celebrate their 23rd wedding anniversary on
Friday last week.
"We've never had a fight in the whole time we've been married and didn't have one now,"
Geoffrey said.
But his mates are unlikely to let him forget it. "They keep ringing me up and saying
'Hey mate the price of gold has just gone up'.
"I'm like - shut up will ya?"

--Chinese Renren eyes USD500m in US flotation
INTERNET BUSINESS NEWS-(C)1995-2011 M2 COMMUNICATIONS
21 February 2011 - Chinese social network Renren.com is planning a US flotation this year, looking to raise some USD500m (EUR365m), the Financial Times reported citing sources familiar with the matter.
If the initial public offering (IPO) goes ahead, Renren will be among the first listed representatives of a sector that has been growing by leaps and bounds. Investors are eagerly awaiting opportunities to capitalise on this tremendous growth and Chinese companies have the added bonus of operating in the most populous market on the planet.
It is yet unclear what valuation the IPO will give Renren, which has hired Deutsche Bank as one of the offering managers.
Renren began life in 2005 as Xiaonei and was acquired a year later by Oak Pacific Interactive. The company has yet to allow a glimpse into its financial results but has revealed that advertising revenues more than doubled in 2009 and 2010.

Fed: Abbott calls for insulation letters
BRISBANE, April 27 AAP - Opposition Leader Tony Abbott has called on the prime minister
to release correspondence between minister Peter Garrett and himself over the failed insulation
scheme.
Mr Abbott visited an insulation storage facility in northern Brisbane on Tuesday, where
he was told the company was facing extremely difficult business circumstances.
"I don't know if we can keep our doors open much longer," said director of Higgins
Insulation, Cliff Aldridge.
Mr Abbott said Kevin Rudd needed to come clean over Labor's now-axed $2.45 billion
scheme, which has been linked to four deaths and more than 120 house fires.
He said the government had squandered billions of dollars on its stimulus programs,
leading to 240,000 "dodgy or dangerous" insulation installations.
"But there are also hundreds if not thousands of businesses which are in a dire financial
situation because they relied on the government's promises," Mr Abbott said.
"This is probably the most botched government program in living memory."
Mr Aldridge said his company had geared up for "two years of stimulus".
"We can't give the stuff away now - we are having to store it," he said.
"It's a very, very grim future."

Qld: Greenpeace protesters arrested for scaling coal terminal
BRISBANE, Aug 5 AAP - Four Greenpeace activists have been charged with unregulated
high-risk activity after climbing onto a section of Australia's northernmost coal terminal.
The Greenpeace vessel Esperanza on Tuesday stationed itself near the Xstrata Coal operated
Abbot Point terminal, 25km north of Bowen in north Queensland.
Activists then climbed onto a section of the terminal, which is undergoing an expansion
to double its capacity, but were unable to unfurl a massive banner due to high winds.
The protest - which did not disrupt coal loading - was timed to coincide with this
week's Pacific Islands Forum meeting where a regional approach to climate change will
be discussed.
Protesters say the government is not taking enough action against climate change as
Pacific Island leaders call for major emission cuts from Australia and New Zealand to
save their homes from rising sea levels.
Police charged a 33-year-old man, a 37-year-old man, a 27-year-old man and a 24-year-old
woman with unregulated high-risk activity.
They will appear in the Bowen Magistrates' Court on August 11.

Mr Rudd said the Australian Defence Force assistance to the relief operation included
a joint task force headed by the army's 4 Brigade commander, Brigadier Michael Arnold,
with more than 450 personnel.
Soldiers were helping police with the search for and recovery of remains while others
have established a tent town for those who have lost their homes.
As well, Defence personnel were operating heavy machinery to carve firebreaks and reopen
roads and trails.
Four armoured personnel carriers were being used for communications while Defence had
been asked to provide aerial imagery of affected areas.
"This will enable identification of all residences affected by fire," he said.
A team of 90 Australian Federal Police (AFP) officers were helping Victorian police
in the investigation of the fires. Among them are 16 specialists in disaster victim identification.
Mr Rudd said he and Families and Community Services Minister Jenny Macklin had conveyed
to the Victorian police that if any further Defence or AFP personnel were required, they
would be made immediately available.
Mr Rudd said the federal government would provide an extra $5 million for emergency
relief from the bushfires in Victoria and floods in Queensland.
Mr Rudd said Australians were left speechless at the thought and possibility that some
of the fires might have been deliberately lit.
"Every member of this house cannot comprehend how anyone could ever do that," he said.
"Something which the nation must now attend to as a matter of grave urgency is the
problem of arson, where it happens, why it happens, what more can be done about it."
Mr Rudd said there was no excuse for it.
"This, as I said yesterday, is simply murder on a grand scale," he said.
"Let us attend to this unfinished business of the nation and come to grips with this evil thing."
Mr Rudd praised emergency services workers.
"We salute each one of them."
He said many people had been traumatised by the bushfires, and promised the government
would try to make sure there were enough counsellors to help all those who faced shattered
lives.
"This is an unspeakable horror for those families, unspeakable."
"The trauma of scarred and blackened vehicles along the road, that I saw yesterday,
to Marysville."
"The physicality and the emotional scar of trauma reaches deep into people."
Mr Rudd said all levels of government should work together, along with communities
and community organisations, to cope with the challenges.
"We do not know what lies ahead," he said.

Ath: Hooker is the complete package
AAP General News (Australia)

Ath: Hooker is the complete package
By John Salvado
BEIJING, Aug 23 AAP - Flawless bloodlines. Great coaching. And the ability to hold
his nerve time and again on the grand stage.
Australia's first Olympic male track and field gold medallist in 40 years has the full package.
Steve Hooker's spine-tingling pole vault triumph last night in Beijing was many years
and many people in the making.
Hooker was always going to take up athletics, being the son of Erica Hooker, a 1972
Olympian and 1978 Commonwealth long jump champion, and Bill Hooker, who competed in the
4x400m relay and 800m at the 1974 Commonwealth Games.
But it was pure coincidence that he was attracted to the pole vault.
At the time in the late 1990s, the star of his local Box Hill Athletics Club was former
Flying Fruit Fly Circus member Emma George, who was regularly breaking world records in
the women's vault when the event was in its infancy.
Hooker convinced George's coach Mark Stewart to let him join their squad.
Stewart turned him into one of the world's best vaulters, but by 2005 Hooker knew he
needed a change.
He wanted a full-time coach, one that could travel with him to Europe for the major competitions.
So Hooker went west to Perth, where ex-Russian vaulter Alex Parnov had built a reputation
as one of the world's best coaches, having guided the fortunes of Dmitri Markov, Tatiana
Grigorieva, Kym Howe and Paul Burgess, among others.
He also coaches his daughter Vicky Parnov, the niece of Grigorieva, who represented
Australian at the Melbourne Commonwealth Games and last year's world championships as
a teenager.
"Both of my coaches have been the biggest influences in my life," said the 26-year-old Hooker.
"Without Mark Stewart I probably would not have even started pole vaulting, never had
the early part of my career.
"I never would have learnt to just be a fierce competitor and guts things out.
"Then after moving to Perth, Alex taught me all sorts of thing about technique, about
being professional, about lifestyle, about everything.
"They have both had such a big influence and without either of them all the pieces
wouldn't be there for this to have happened."
Four times in the qualifying round and the final, Hooker was on the verge of elimination,
only to get the necessary clearance on the third and final jump.
The final clearance at 5.85m was edge of the seat stuff, as Hooker willed himself over
the bar at an awkward angle after nearly pulling out during his run-up.
And after clearing the gold medal height of 5.90m he ran straight to Parnov and was
rewarded with a big Russian bear-hug.
"Alex is probably one of, if not the best coach in the world and I've always had a
lot of respect for him and the way he coaches," said Hooker.
"It's a tribute to him now that he's coached an Olympic gold medallist because he definitely
deserves it."
The victory was a far cry from his 23rd-place finish at the Athens Olympics, when he
was still using an abbreviated 12-step run-up, rather than the full 16.
He also bombed out at last year's world championships, finishing ninth after going
into the event as the world No.1.
Hooker paid tribute to the role played by his parents, who watched the dramatic competition
unfold on television from their Melbourne home.
"I'm lucky, I've got good genetics which is a fairly good head start for most people,"
said Hooker, who was also a good junior-level Australian rules footballer.
"But also having level-headed parents, they didn't push me into anything at an early
age, they've never pushed me into anything during my career.
"They are just supportive people who'll do anything for me, they're just two of the
best parents anyone could ask for.
"It's kind of cool having an Olympian for a Mum because you realise Olympians are just
normal people and she was just the person that washed my clothes and told me off when
I did bad things.
"But she went to the Olympics, so to me it seemed like it was something that was achievable
for anyone."
Hooker was Australia's first male athletics gold medallist since Ralph Doubell in the
800m in 1968 and the first man to win an Olympic field event since high jumper John Winter
60 years ago.

Qld: Fatal plane crash caused by poor maintenance: report
An investigation has found poor engine maintenance caused a fatal plane crash off the
New South Wales north coast early last year.
On February 4 .. 2007 .. a 61-year-old Gold Coast man died when his Twin Comanche plunged
into the ocean about 100 metres off Kingscliff Beach at Casuarina.
The pilot was conducting a maintenance flight .. but radioed for help when his right
engine failed just 11 minutes after takeoff.
He told air controllers he'd be unable to make it back to the airport .. saying he'd
attempt to land on a beach.
An Australian Transport Safety Bureau report released today has found the plane's left
engine experienced a surge in power shortly before the crash.
This forced the plane to uncontrollably veer right as the pilot attempted his landing.
Investigators have found the right engine failure was likely due to a loss of oil pressure
.. caused by a blockage or obstruction.

NSW: No verdict yet on doctor's manslaughter trial
SYDNEY, Aug 18 AAP - The jury in the trial of a Sydney abortion doctor accused of the
manslaughter of a premature baby boy has not yet reached unanimous verdicts, the NSW Supreme
Court has been told.
Suman Sood, 56, has pleaded not guilty to the charge and to two counts of procuring
an illegal abortion.
It is alleged that in May 2002, she unlawfully gave the drug prostaglandin to a 20-year-old
woman, in preparation for an abortion procedure.
Early the next morning, the woman gave birth on the toilet at home to a four-months
premature baby boy, who was pronounced dead several hours later, the court has been told.
Sood has denied giving the woman prostaglandin or agreeing to terminate her pregnancy.
Justice Carolyn Simpson today said she had received a note from the jury, which retired
to consider its verdicts on Friday afternoon.
"I've been told that you have not been able to reach a unanimous verdict so far," she said.
Justice Simpson said she had the power to discharge the jury, but only if she was satisfied
there was no prospect of genuine agreement being reached.
"Experience has shown that jurors often can agree if given more time to consider and
discuss the issues," she said.
The judge urged the jury to continue deliberations, and to calmly and objectively consider
the evidence.

SYDNEY, April 16 AAP - Sets of stairs are to be installed alongside Sydney's underground

The stairs and sets of landings will be placed at 70 metre intervals along the tracks,
with RailCorp also considering new devices that detect a chemical or biological attack

The Sunday Telegraph reports that the NSW government has issued tenders for more than
500 sets of the aluminium stairs that will allow 40 passengers a minute to disembark from
carriages.
This is four times more than is possible in the current system of using ladders.
Passengers will then be led out of tunnels along walkways to the nearest platform.
The Telegraph also reports that shutter doors will be installed at Sydney's underground
train stations to seal them off in an emergency.
The first of these doors will be installed at Central Station immediately, costing $50,000.

Tele-home care.(HOMECARE)
As reimbursement continues to decline and demands for services and costs associated with providing a respiratory therapist in the home continue to escalate, the DME provider is being forced to search for alternatives to the traditional delivery of home respiratory care. The loss of productivity due to the time spent driving from one patient to another is a major cost. One such alternative, which improves patient care, increases productivity and reduces costs, emerging not only in home care but also in medicine in general, is the use of telehealth. Telehealth refers to the use of information and communication technology to deliver health care services, expertise and information over a distance.
[ILLUSTRATION OMITTED]
The feasibility for a DME provider to utilize tele-home care has grown in recent years. The cost of the technology has decreased and continues to become more user friendly. Once more, there is little to no start up costs for the majority of these services if the provider can use a PC already owned by their organization.
CPAP, Auto-Titration and Bi-level Airway Pressure systems have an assortment of options to apply tele-home care and have shown tremendous potential over the past few years. Compliance data has gone from a luxury to an essential component of home care sleep program in many parts of the U.S. Higher end systems can also provide hyponea and apnea data as well. Some systems can send the data through the Internet via a modem and provide an email to the clinician if compliance falls below a predetermined level. Changes in settings can also be accomplished over the Internet. One manufacturer is using technology to send data and parameter changes on a data card the size of a credit card. After obtaining compliance data, the card is returned to the home care provider by mail and downloaded by the clinician at the office. With either Internet or data card systems the patient does not have to be tracked down to have a home visit made. This improves productivity because a majority of CPAP patients are working during the day making contact and home visits difficult.
Infant apnea monitoring programs have had the capability to provide tele-home care for several years. The cardiopulmonary monitor can be interfaced with a modem and the necessary downloads can be obtained without any travel. This can be especially beneficial when a caregiver is unsure whether or not an Apparent Life Threatening Event has occurred or not. By being able to obtain this data in a more timely manner than traditionally possible the physician is provided with this data faster and can aid in determining if the infant requires hospitalization or not.
Liquid oxygen systems can be equipped with technology to monitor the amount of product in the patient's home. This information can be electronically transmitted thorough a modem to the DME provider. This allows for more cost-effective delivery systems to be put into place. Instead of routinely filling liquid vessels at a specific interval, such as once a week, a vessel potentially can be filled with longer intervals between fills. This equals fewer visits to the patient's home over the coarse of the year.
This is just the beginning of tele-home care for the respiratory therapist. As America's baby boomers age and life expectancy increases, there will be a significant rise in the number of patients requiring home respiratory care. Tele-health makes good sense because the appropriate use of this technology will improve the quality of care for the patient. Cost savings can add up very quickly with the average home care visit estimated to cost a DME provider fifty dollars (sure to go higher in the future.)
While the use of tele-health has benefits, there are still questions which need to be answered. As privacy, security and confidentiality have become major issues, health care must also be aware of these issues as well and be vigilant of the potential problems which can occur if a program is not set up and managed properly. Confidentiality is the status given to information, which indicates the information is sensitive and must be protected and access, controlled. Security is the safeguards used within the information system to protect the system and its contents from unauthorized disclosure of information. Congress has realized that these are real issues for tele-health and has passed multiple pieces of legislation to aid in ensuring that privacy will be maintained for everyone. The Federal government has regulated that the FTC will be in charge of overseeing privacy protection online. Working with the manufacturer of the equipment and software will aid in insuring that all systems protect the patient's rights and the organization.
As tele-home care moves forward, additional research will be required to evaluate and quantify the effectiveness and efficacy. To date there are some anecdotal and almost no scientific studies documenting the benefits of tele-home care. I was unable to find a scientific data relating directly on how home respiratory care programs have benefited from tele-home care. Further study is needed to determine the impact on quality of care, cost, patient and health care provider satisfaction. The use of tele-home care has only just begun and as technology improves further these and other new applications will become part of the standard of practice for home care. The use of video imaging is already being applied to home care and may be a reality as well in the future. We must remain aware of changes in technology in order to provide the best possible care to the patient in the future.

'Gender-neutral' Army hoax misfires...because so many troops believe it.(News)
Byline: Christopher Leake DEFENCE EDITOR
IT BEGAN as an April Fool's joke. An article in the Army's official magazine claimed that ancient ranks and titles were to be replaced with 'gender-neutral' alternatives to comply with EU equality laws.
Guardsmen would be called 'protector', 'sentinel' or 'escort'. Craftsmen would be known as 'artificers' or 'tradespersons', it said. There was a even a clue to the bogus nature of the story in the name of the officer said to be leading the 'diversity drive' - a Lt Col Avril Bridgeman. Avril is the French word for April and no such person exists. But the prank backfired when scores of troops took it at face-value and complained on Armed Forces internet blogs and messaging boards.
One furious posting read: 'Maybe the next step will be to change our surnames if they are likely to offend others. Lt Col Avril Bridgeman, the officer leading the equalinspirED ity and diversion drive, should be renamed Lt Col Avril Bridgeperson.' A contributor to another site added sarcastically: 'It's good to see the MoD can find money to fund this important initiative.' The article in Solider magazine, headlined 'Gingerbread Clause Prompts Changing Of The Guard', explained the supposed effects of the Equality Act 2010.
It said: 'One solution being mooted is simply taking the "man" out of each title and inserting "person" in its place, which would comply with European law.' It added: 'Many of the old rank titles are not relevant to modern society and the MoD is keen to acknowledge the increasingly important role women play within our Armed Forces.
'There will obviously be traditionalists out there who will strongly object to any rebranding, but so far those in favour of gender-neutral names outnumber the dissenting voices.' The report said officers would not be affected as titles such Captain, Colonel and General were applicable to both men and women, so did not cross the 'sexist threshold'.
It added: 'Senior officers within each arm of the service are preparing a number of options to prevent potential litigation cases from personnel who feel discriminated against.' The article was given further credence by quoting what purported to be an official Ministry of Defence spokesman as saying the changes would be subjected to consultation before being introduced next year.
The story was written so convincingly in the style of real Army announcements that many were fooled. One contributor to the Coldstream Guards message board wrote: 'It would appear that very soon we will no longer be called Guardsmen. We may be called Protector, Escort or Sentinel, but not Guardsmen.
'This is because of the Equality and Human Rights Commission 2010 ruling.
Any soldiers such as Kingsmen, Craftsmen, Riflemen etc must expect a name change.' Another servicemen said the title Signaller had already replaced Signalman 'to cater for the ladies'.
National newspaper journalists were also taken in, and rang the MoD for a comment.
It's not the first time the magazine has duped readers.
In April 1980, its claim that hair on bearskins worn by soldiers continued to grow was repeated as fact by several newspapers.
Andy Simms, managing editor of Soldier, said last night: 'Now in its 66th year, Soldier has a long history of running April Fool's articles in the magazine's April issue.
'This year was no exception and, based on the suggestion of a serving reader, the editorial team at Soldier came up with the Gingerbread Clause of the Equality Act and the fictitious Lt Col Avril Bridgeman for 2011's spoof article.
'The Army is renowned for its robust sense of humour and, in keeping with this characteristic, the report was in the main quickly identified as a joke and greeted with the wry smiles intended.
'Yes, a number of people were taken in by the hoax - among them several national journalists - but the dozen or so who contacted the magazine in respect of the piece took it in good humour when pointed in the direction of the magazine's cover date.'

Western Pacific Airlines Slashes Fares.(Originated from Gazette Telegraph, Colorado Springs, Colo.)
COLORADO SPRINGS, Colo.--Jul. 31--To fill its jets in the post-summer vacation lull, Western Pacific Airlines is slashing its fares for the next two weeks for fall travel.
WestPac is offering seats at $49 one-way to eight Midwest cities; $69 to 10 Midwest and West Coast cities; and $99 to four cities on the East Coast.
Seating is limited, but WestPac Chairman Edward Beauvais said the discounts apply to about half the 138 seats on each of its Boeing 737-300 jets.
"We were concerned that people will get complacent after the Olympics," Beauvais said. "We want to make fares so cheap they can't afford to stay home."
The fare sale begins today and expires Aug. 14. WestPac requires a two-week advance purchase. The sale applies to travel beginning Aug. 14 through Dec. 14. The discounts do not apply to travel during the Thanksgiving holiday period of Nov. 26 to Dec. 3.
The sale prices represent about a $30 discount for each roundtrip over standard WestPac fares.
"It's a savings," said Linda Robison, who expects phones to be ringing at her Academy Travel & Tours Inc. "Although $30 doesn't sound like much for one ticket, for a family of four that's a $120 savings. You can afford to take grandma along."
For example, WestPac's lowest roundtrip fares for a trip from Colorado Springs to Newark, N.J., is $228. The discount lowers that price to $198.
To Dallas, the current roundtrip rate is $128. It drops to $98 with the sale.
And to San Francisco, WestPac offers a late-night fare of $138 and daytime prices of $168. The sale price is $138 good day or night.
The fare sale will not apply to WestPac's new Mountain Air Express, which does not start flying until Dec. 4.
Its fares will range from $69 to $119 for flights to Aspen, Crested Butte-Gunnison, Vail-Eagle, Steamboat Springs, Telluride-Montrose and Purgatory-Durango.

Our experience in creating web-based modules for organisations such as Jaguar, Ladbrokes, and BP helped us design a dynamic set of 20 exercises that allows Memory Concepts to change the content themselves very frequently rather than having to use a web designer to change it for them."
"We conducted extensive tests using Flash to ensure that the solution was efficient, taking all the variables into account, such as the different answers and possible spelling variations to the questions. Memory Concepts can easily modify the configuration files and JPEGs to incorporate fresh content."
Scott C. Sanchez, Chief Information Officer at Memory Concepts adds, "After an extensive search, we turned to Peppercorn to help us develop the web-based exercises that serve as the core of our memory fitness program. We pushed Flash to its limits with some of our memory exercises, and Peppercorn did the research and put in the time to make it happen on schedule."
"Peppercorn successfully designed a solution that was not only cost effective to Memory Concepts, but also helped us offer our clients a valuable resource designed to help them increase brain capacity. The exercises are part of a complete database-driven system that allows the user to track their progress over time, which is important for keeping people motivated.
Furthermore, by allowing us to dynamically change the content within the exercises, we are able to keep the content fresh and keep our clients engaged."

Sex.Com Settles Monumental Case Against VeriSign/Network Solutions; Six-Year Contested Court Battle Is Over.
SAN FRANCISCO, April 20 /PRNewswire/ -- Sex.Com (www. sex.com) announced today a final settlement with VeriSign (formerly Network Solutions, Inc.), concluding a six-year legal fight that set several important precedents for the future of the Internet. After the Ninth Circuit Court of Appeals granted Sex.Com a sweeping victory that held VeriSign/Network Solutions, Inc. (collectively "VeriSign") strictly responsible for mishandling the famous domain name, Sex.Com and VeriSign have settled Sex.Com's lawsuit against VeriSign.
The implications of the lawsuit are far-reaching in all areas of Internet infrastructure and governance, as well as intellectual property law. Sex.Com single-handedly caused the courts to define domain names as property, and thus changed the laws governing the World Wide Web.
"After years of litigation, the Sex.Com legal battle set the key precedent requiring domain name registrars to be accountable for their mishandling of such an important public resource as the Internet domain name system," said Robin Gross, an attorney who specializes in cyberspace law. "Now, registrars must use the same level of care as any other business and will be responsible for abusive practices," she added.
In October 1995, Stephen Michael Cohen, a many-time convicted felon, had supposedly sent a forged letter to VeriSign, requesting the transfer of the Sex.Com domain name from Kremen, the rightful owner of the name. VeriSign led the courts to believe that Cohen made this request via a forged letter. It now appears that Cohen simply picked up the phone, asked for and was granted the Sex.Com domain name immediately. This was at a time when the queue for domain names was over four weeks. VeriSign made no attempt to verify Stephen Cohen's connection to Sex.Com -- of which there was none.
"It was already damaging that VeriSign had taken my domain name away from me without my permission, and refused to give it back when shown proof that it was stolen," said Gary Kremen, chief executive officer of Sex.Com. "I'm ecstatic that we have reached a settlement so we can put the case behind us and find peace in knowing that the Ninth Circuit's opinion in the Sex.Com case will have an influential role in holding Internet registrars responsible for mishandling their customers' domain name properties."
In its landmark decision, the U.S. Court of Appeals found that VeriSign was subject to the tort of conversion by not returning property that was owned by another party. Despite Kremen's written complaints with absolute proof, VeriSign did nothing to use their powers to reverse their improvident transfer.
"The decision of the Ninth Circuit was a great victory for Internet Domain Name registrants, and Mr. Kremen's perseverance in securing that decision was truly commendable," said William Bode, managing partner of the Washington, D.C. law firm, Bode & Grenier, LLP, General Counsel for the American Internet Registrants Association, and author of a friend of the court brief filed in the case. "Hundreds of domain name registrants lost their valuable property due to the negligence of Domain Name Registrars. The court's decision proclaimed that those afflicted registrants have a remedy under law to recover their damages -- providing much-needed protection to Internet entrepreneurs. This ultimately will enhance Internet commerce."
Douglas Masters, a partner with Loeb & Loeb LLP in Chicago, Illinois, says, "Gary's Sex.Com victory is likely to influence legal developments in important areas beyond domain names. In this digital age, the handling of intangible property has taken on enormous importance. The 9th Circuit's decision is an important step in applying settled principles to this new realm."
Kremen (http://www.kremen.com/) was awarded a $65 million judgment against Cohen for stealing the domain name, which the U.S. Supreme Court declined to overturn on June 12, 2003.
