ROCHESTER MAN CHARGED IN CHILD PORNOGRAPHY CASE

S. Attorney's office for Western District of New York issued the following press release:

S. Attorney William J. Hochul, Jr. announced today that Robert Miller, Jr., of Rochester, NY, was charged by Criminal Complaint with the knowing receipt and distribution of child pornography and the knowing possession of child pornography. The charges carry a mandatory minimum penalty of five years in prison and a maximum of 30 years, a $500,000 fine or both.

Lee, who is handling the case, stated that according to the Complaint, New York State Police executed a search at the defendant's residence on Brayton Road in Rochester, NY. in February 2011 after conducting an undercover investigation involving the use of peer-to-peer file-sharing software. During the search, several computers and electronic media items were seized. A review of some of the images recovered from one of the computer hard drives appeared to depict child pornography. The Complaint further alleges that Miller admitted to searching for child pornography files on the Internet and to downloading child pornography files on his computer using peer-to-peer software.

This case was brought as part of Project Safe Childhood, a nationwide initiative to combat the growing epidemic of child sexual exploitation and abuse launched in May 2006 by the Department of Justice. Led by United States Attorneys' Offices and the Criminal Division's Child Exploitation and Obscenity Section (CEOS), Project Safe Childhood marshals federal, state and local resources to better locate, apprehend and prosecute individuals who exploit children via the Internet, as well as to identify and rescue victims. The Criminal Complaint is the culmination of an investigation on the part of the Special Agents from Immigrations and Customs Enforcement, Homeland Security Investigations, under the direction of Lev Kubiak, Special Agent in Charge, and the New York State Police's Computer Crimes Unit under the direction of Captain Frank Pace.
